Illinois is set to become the third state in the country to mandate paid time off for all workers, following Nevada and Maine. The Illinois Paid Leave Law passed both houses of the Illinois legislature on Jan. 10, 2023, and will go into effect on January 1st, 2024. This law will require nearly all covered Illinois employers to provide their employees with up to 40 hours of paid leave per year for any purpose. Coverage & Excemptions

The Paid Leave for All Workers Act applies to all employers in Illinois, including state and local governments, except for school districts organized under the School Code or park districts organized under the Park District Code.

This law covers all employees, except for those who are exempted, such as employees covered under the federal Railroad Unemployment Insurance Act or the Railway Labor Act, temporary college or university students-employees, certain short-term employees of an institution of higher learning, and employees working in the construction industry who are concerned by a bona fide CBA with an employer that provides services nationally and internationally of delivery, pickup, and transportation of parcels, documents, and freight.
